Terms & Conditions for Never Stop Packing Travel LLC

These terms and conditions ("Terms") govern the relationship and services to be provided between Never Stop Packing Travel LLC ("the Agency") and you, the client ("Client" or "Traveler(s)"). By seeking the services of the Agency, the Client agrees to the following Terms.

   

When you retain Never Stop Packing Travel LLC to help plan your vacation trip, you’re hiring a professional travel advisor to ensure that your trip is tailored to your taste, preferences, and budget. You get the benefit of our skills and training, our professional relationships, and our industry connections. 

By planning travel with Never Stop Packing Travel LLC, you agree to be bound by these terms and acknowledge that Never Stop Packing Travel LLC acts solely as a booking agent for the disclosed principal suppliers, tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services, hereby called “Supplier(s)”, and acknowledge that the Agency is not the source or provider of the travel services. The Agency’s sole responsibility is to book travel for the Client and will not be responsible for anything other than booking travel.  These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to Never Stop Packing Travel LLC.

 

Service Agreement

 

The Agency shall provide travel planning and booking services as requested by the Client. This may include, but is not limited to, flight bookings, hotel reservations, car rentals, excursions, and any other related services. The engagement of Never Stop Packing Travel LLC (the Agency) as your travel agent and vacation planner, will grant the Client the below benefits/services. These services may vary, depending on the Travel Planning Package  purchased.

 

  • Discuss the Client's needs and suggest a suitable travel package

  • Research with our top airfare, hotels/resorts and cruise suppliers and find options that meet the Client's travel needs  

  • Find the best travel agent rates, whenever possible and available, to keep the Client's vacation investment within the pre-established budget

  • Organize the Client's travel from beginning to end including, but not limited to, coordinating airfare, hotel accommodations, transportation, tours, make reservations for ancillary services such as restaurants, theme parks, create a detailed itinerary and handle all check-ins (where applicable and needed) and contact suppliers (if needed)

  • Provide the Client with resources where the Client can find information for any documentation required by the destination country such as any visa requirements, vaccination requirements recommended and any other entry requirements needed for the Client's trip

  • Availability to assist with anything the Client may need, related to your trip, from the planning stage up to the Client's return home

 

The Agency will ensure that the services are provided in accordance and within an agreed time frame and to a professional standard. All vacations arranged through the Agency offer peace of mind, as the Agency is in the business of planning travel for those who demand the most professional, individual attention to detail and execution of a well-planned vacation. 

 

Your Commitment

 

The Client understands that any recommendations and resort selection process is dependent on quality feedback and communication. Effective communication and specific feedback are vital to a productive, collaborative relationship. As part of this Agreement, the traveler commits to providing timely and detailed feedback on the resort and/or destination recommendations.

 

Agent for Suppliers 

 

The Agency acts as a sales agent for any airline, hotel, car-rental company, railroad, transportation provider, tour operator, cruise line, or any other service provider named in your itinerary or confirmation and herein referred to as the (“Supplier(s)”). The Suppliers whose names appear in the confirmation and/or itinerary provided, are the party responsible for providing the travel services that the Client has purchased. 

 

Use of Never Stop Packing Travel LLC’s Services

 

You, the Client, warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with the Agency. You agree to be financially responsible for all of your travel bookings and warrant that all information supplied by you on behalf of yourself, members of your household, those in your travel party or others for whom you are authorized to transact business with us, is true and accurate. You agree that you will only make legitimate reservations or purchases with the Agency and its Suppliers, and acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.

 

All bookings are accepted by the Agency as agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree to abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider for your travel. 

Proposal & Booking Process

 

Below find a description of our proposal and booking process:

 

Step #1- Schedule a Vacation Planning Session (Call)

We will schedule a Vacation Planning Session call, at your convenience, to discuss what travel needs and expectations you have for your trip.  During this call: 

1.     We will provide some recommendations for your trip, based on the information we gather from you;

2.     We will suggest the best Travel Planning Package that will fit your needs;

3.     We will discuss the fees applicable to the travel planning package of your selection.

 

This information will help us know if we are a good match to work with each other and if I can be of assistance.

Step #2 - Sign Client Engagement Letter

After our Vacation Planning Session call, and if you are seriously interested in engaging our travel planning services, we will send you a "Client Engagement Letter" (CEL).

This Client Engagement Letter will describe the services we will provide throughout your vacation planning process and during your vacation time, based on the Travel Planning Package you've selected. It will also confirm the cost of your Travel Planning Package and the different types of payment methods available for you to submit payment.

 

After you have reviewed and agreed with the CEL, you will electronically sign it and return it to us. You will then receive an invoice for the Travel Planning Package you selected and options to submit payment.

 

​Step #3 - Research and Planning Begins

Once your signed Client Engagement Letter has been received, as well as the payment of the fees for the service package you have selected, we will begin the necessary research with all applicable suppliers, to create a proposal that will fulfill all your travel needs. This process could take up to seven (7) days approximately, depending on how many proposals have to be created and how many amenities or services are needed for each. 

Step #4 - Review, Approve & Book your Trip

Once you receive, review, and approve the proposal that works best for you, we will send you an invoice with a credit card authorization for any deposit or full payment that may be required by the suppliers you will be using. We will then proceed to book with the corresponding suppliers, as well as make any reservations that are needed to complete your travel itinerary.

Step #5 - Confirmations go Out

Once all your bookings and reservations are done, we will send you via email an updated itinerary that will include all confirmation numbers and/or any information you may need during your trip.

 

Proposals/Quotes

 

Our prices are quoted in U.S. Dollars (USD) and are not guaranteed until the time of deposit or full payment is received.  All prices quoted are accurate at the time of quotation, but prices and availability are subject to change at any time and without notice. 

 

Prices are not established by the Agency, but by the Suppliers, and the Agency will have no control over price fluctuations and/or changes emitted by the Suppliers. Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice or reservation itinerary, the Agency does not guarantee any of such Suppliers' rates, bookings, reservations, connections, scheduling, or handling of personal effects.

 

If at the time the Client decides to book the trip prices have changed, the Agency will re-issue an updated quote with new price change, if any apply. If travel is not booked within 60 days of issuing your proposal, a new travel planning fee will be charged, due to the Agency having to re-do research and provide updated costs to all of the components in your itinerary. It is the responsibility of the Client to complete and return all necessary documents, as well as providing payment in a timely manner.

 

Fees and Payment  

 

The Agency's fees will be communicated to the Client upfront, during the planning call or session with the Client. All fees are due upon receipt of invoice unless otherwise specified by a due date. Additional charges and expenses incurred during the trip are the responsibility of the Client unless stated otherwise.

 

Convenience Fees

 

Due to the cumulative nature of credit card processing fees, which may seem minor at first glance but add up substantially over time, the Client will find these fees incorporated into all invoices and is responsible for paying them. This ensures that the Agency can continue to deliver exceptional value without compromising on the custom-made experiences we curate for you. The Agency has named this charge a "Convenience Fee". The Convenience Fee entails of a charge of 4.5% of each invoice + an additional charge of $0.30 for each payment processed via credit card.

 

Travel Planning Packages Fees

 

The Agency offers different types of Travel Planning Packages, each designed to meet specific travel needs of the Client. Below you will find a brief description of each package and its corresponding fees:

Basic Travel Planner Package - $150 | This package is ideal for the budget traveler looking for a simple plan. It includes the following services:

 

Destination Research: Handle all the research, based on your needs, and provide the top 2 recommended destination spots. Suggestions will be provided in the case where you are unsure where to go on vacation. 

Accommodations: Suggestions with the top 2 best accommodations options, based on your needs/preferences and budget

Proposal: Proposal for up to 2 destinations spots, including airfare, hotel/resort accommodations and transfers (if required). This package includes 1 proposal revision. Each additional revision will incur a $25 fee.

Safety: Will provide a list of local hospitals, embassies, and local emergency numbers, for your reference.

Support: Messaging/Phone support during the length of your trip.

 

 

Premium Travel Planner Package - $300 | This package dives deep with tailored plans for the ultimate experience. It includes the following services:

 

Destination Research: Comprehensive destination research for up to 3 destinations. Will include information on local culture, history, festivities, and must-knows.

 

Accommodations: Suggest the top 3 best accommodations options, based on your preferences, ranging from mid-range to luxury spots.

 

Itinerary: You will get a detailed daily itinerary which will include attractions, activities, and relaxation spots that will go accordingly with your preferences and needs.

 

Proposal: Proposal for up to 3 destinations spots, including airfare, accommodations, and transfers (if required). This package includes up to 2 proposal revisions. Each additional revision will incur a $25 fee.

Booking Assistance: Assistance making spot and restaurant reservations, as well as getting event tickets.

Gastronomic Guide: Will provide some local dining suggestions where you can savor the destination with top eateries, from street food to fine dining.

Transportation: Recommendations from scenic routes to efficient local transit options.

Basic Local Etiquette and Tips: Quick tips on local customs & etiquette.

Shopping Guide: Best places to buy souvenirs, local crafts, and specialties.

Nightlife Recommendations: Handpicked nightlife venues, from vibrant local spots to cultural performances.

Safety: Will provide a list of local hospitals, embassies, and local emergency numbers.

Support: Messaging/Phone support for real-time recommendations and changes during the length of your trip.

  

Luxury Experience Travel Planner Package - $400 | This package is for those seeking a lavish and stress-free vacation and where you will experience luxury travel redefined with our custom-made plans, curated for discerning travelers. It includes the following services:

Luxury Destination Overview: Focusing on high-end experiences and exclusivity with detailed insights into the high-end offerings of the locale.

Luxury Accommodations: Booking of 5-Star resorts, boutique hotels, or exclusive villas.

Daily Itinerary: Tailored to personal interests and luxury preferences.  Personalized with daily activities and reservations, balancing relaxation and adventure.

Proposal: Proposal for up to 3 destinations spots, including airfare, accommodations and transfers and any other ancillary service needed. This package includes up to 3 proposal revisions. Each additional revision will incur a $25 fee.

Gourmet Gastronomic Guide: Bookings at Michelin-starred restaurants, private chefs and exclusive culinary experiences.

Private Transportation: Coordination of transfer and/or transportation services such as limousines, private chauffeured cars, private jet or any other elite mode of transportation.

VIP Experiences: Get access to private shows, members-only clubs, and exclusive experiences.

Basic Local Etiquette and Tips: Quick tips on local customs & etiquette.

Personal Shopping Assistance: Guidance on luxury shopping, including private viewings.

Wellness and Relaxation: Reservations at top-tier spas, wellness centers, and retreats (if required).

Safety: Will provide a list of local hospitals, embassies, and local emergency numbers.

Support: Premium messaging and phone support service prior to departure and 24/7 messaging and phone support, for a seamless travel experience, during the length of your trip.

Group Travel Planning Package - $500 | This package provides tailored travel solutions for groups of families, friends, and corporate groups ensuring memorable moments for everyone! How many guests are considered a group, anything greater than 8 people.  It includes the following services:

Group Dynamics Analysis: Understanding the diverse needs of group members for a balanced trip. (Kids, teens, adults, seniors)

Destination Shortlist: Top 3 destinations fitting the group's collective interests and needs.

Accommodation Recommendations: Best options for group stays such as villas, suites, adjacent rooms, or group-friendly hotels, based on the group preferences.

Proposal: Proposal for up to 3 destinations spots, including airfare, accommodations and transfers and any other ancillary service needed. This package includes up to 3 proposal revisions. Each additional revision will incur a $25 fee.

Group Activity Itinerary: Day-by-day plan, including attractions and activities catering to all ages and interests.

Dining Reservations: Suggestions and reservations for restaurants suitable for groups, considering diverse dietary needs and preferences.

Group Transport Solutions: Recommendations for large vehicles, charters, or other modes ideal for group transit.

Event/Group Booking Assistance: Help with booking group tickets to attractions, shows, or events, ensuring adjacent or grouped seating where possible.

Transportation: Recommendations from scenic routes to efficient local transit options.

Basic Local Etiquette and Tips: Quick tips on local customs & etiquette.

Shopping Guide: Best places to buy souvenirs, local crafts, and specialties.

Safety: Will provide a list of local hospitals, embassies, and local emergency numbers, for reference in case of an emergency.

Support: Premium messaging and phone support service prior to departure and 24/7 messaging and phone support, for a seamless travel experience, during the length of your trip.   e.

DIY Itinerary Blueprint - $89 + $10 for Each Day Planned | Introducing our "DIY Itinerary Blueprint" package, created for travelers who like to do things their own way. With this service, we’ll create a detailed itinerary for your trip full of handpicked activities, must-see landmarks, and personalized experiences. You’ll take charge of making all reservations and bookings yourself.

You Decide: Choose every aspect of your trip, from activities to dining and tours.

Tailored to Your Budget: We'll provide options to help you stay within your budget.

Daily Pace: Decide if you want a fast-paced or well-balanced itinerary; we'll plan accordingly.

Personalized Itineraries: Based on your feedback, we'll create an itinerary tailored to your preferences.

Booking Details: Our itineraries will include all necessary information for easy booking.

Detailed Proposals: Your proposal, which becomes your itinerary, will be fully detailed for each planned day.

 

Travel Planner Package fees are payable at the time of agreement and are non-refundable and non-transferable.  In the unfortunate event that plans are cancelled or if the itinerary is not fulfilled for any reason, these Travel Planner Packing Fees remain non-refundable and non-transferable.

Bank Information

The Client should be aware that the charge description for the Agency's Vacation Planning Packages Fees may reflect differently on credit card statements, from the charges the suppliers will make to the Client's account. The Client should inform the bank/credit card company that will be used.

 

Credit Card Charges and Payment Methods

 

Traveler understands that Never Stop Packing Travel, LLC has relationships with many travel supplier partners; charges on the Client's credit card statement may appear as Never Stop Packing Travel LLC or as the name of a trusted preferred supplier. The Client understands that he/she shall be liable for any and all charges placed on his/her credit cards in the event such charges are declined or charged back for any reason including any unauthorized or fraudulent use of credit card. The Agency shall not be responsible for any losses or damages associated with the fraudulent use of credit card and client shall hold the Agency harmless from any and all losses, damages or claims of any kind arising from or connected to the fraudulent use of credit card.

Due to the cumulative nature of credit card processing fees, which may seem minor at first glance but add up substantially over time, clients will find these fees incorporated into all invoices and are responsible for paying them. This ensures that we can continue to deliver exceptional value without compromising on the custom-made experiences we curate for you. We have named this the charge a "convenience fee". The Convenience Fee entails of a charge of 3.5% of each invoice + a charge of $0.30 for each payment processed via credit card. We appreciate your understanding and are available to discuss any concerns or provide further clarity on this matter. The Agency's Travel Planning Packages and fees may be payable via direct invoice, with a major credit card, or through any the below payment methods:

If the Client cannot submit the fee payment through any of the above payment methods, the Agency should be contacted to make other payment arrangements. Charges that are for Supplier services such as hotels, resorts, flights, etc., must be paid via direct invoice only, in addition any fee applicable.

 

Charges will be reflected in the Client's credit card statement either as Never Stop Packing Travel LLC (the Agency) or in the name of any supplier (airline, hotel, cruise line, etc.) used to book the travel components of the Client's vacation.

  

Travel Documents

 

You will receive digital copies of all your travel documents and itinerary, which will be emailed to you prior to departure.  We believe in saving our trees and reducing waste, as well as taking advantage of the technology tools we have available today. For this reason, all travel documents go out via email by default. In the case where your destination requires printed hardcopy travel documents, these will be mailed to the lead traveler on each booking approximately 15 days prior to trip departure and will incur a fee of $25 per travel packet.

 

The Client is responsible for ensuring they have the necessary travel documents, including passports, visas, and other required documentation to travel. The Agency can offer assistance but is not liable for denials or issues arising due to invalid or missing documents.

 

If you wish to have your travel documents printed, please make sure you request them in writing to info@neverstoppacking.com and provide mailing address where you wish to receive the documents, at least 20 days prior to your departure date. It is the Client's responsibility to review the documents and communicate details to other members in their party, as well as to notify any corrections that may be necessary.  It is also the Client's responsibility to inform the Agency of  any address change as documents will be mailed to the address in your booking. If the documents get returned to us due to incorrect mailing address, we’ll be happy to re-mail the documents for an additional $15 fee.  Electronic documents are highly recommended.

  

Cancellations and Refunds

 

Cancellations made by the Client may incur fees either from the Agency and/or by any of the suppliers used by the Client. The exact amount or percentage will depend on the service providers' policies and will be communicated to the Client. Any refunds due to cancellations will be processed as per the original mode of payment and will be the sole responsibility of the Supplier, unless otherwise noted.

  

Revision (Change) Fees

 

In the event where the Client wishes to make a revision to the original proposal, each trip component revision (ex. hotel, flights, transportation, reservations, etc.)  will incur a $25 fee. This fee will be in addition to any change or cancellation fee each supplier may charge the Client.

 

 What is Considered a Revision

 

  • Destination Changes: Adding, removing, or substituting travel destinations based on preferences, safety, or other factors.

  • Activity Adjustments: Modifications to tours, events, or activities planned in the original itinerary.

  • Accommodation Updates: Changing hotels or lodging options based on feedback, availability, or budget adjustments.

  • Travel Dates: Shifting the travel dates based on client availability or to take advantage of certain events or seasons.

  • Transportation Modifications: Changes in the mode of transport, supplier, routes, or timing based on client preferences or logistical considerations.

  • Meal and Dining Options: Adding, removing, or altering dining reservations or suggestions based on dietary needs or new recommendations.

  • Budget Alterations: Adjusting the proposed expenses to align with the client's budget or updated cost estimates.

  • Duration Changes: Extending or reducing the number of days in a particular location or for the entire trip.

  • Special Requests: Incorporating any unique experiences, visits, or requirements the client might have emphasized after the initial proposal.

  • Safety and Health Measures: Updates related to health advisories, vaccination requirements, or other safety measures, especially in changing global conditions.

  • Local Experiences: Adding or removing local experiences or cultural activities based on feedback or new discoveries.

  • Backup Plans: Suggestions for alternative activities or plans in case of unforeseen circumstances, like bad weather.

  • Additional Information: Incorporating more detailed information on particular aspects of the trip, like historical background, cultural significance, or local tips, which were not included in your selected travel package.

 

Travel Insurance

 

The Agency highly recommends that the Client secures comprehensive travel insurance to protect against unforeseen circumstances. The Agency can provide recommendations but is not responsible for any claims or disputes between the Client and the insurance provider.

 

Travel Insurance can help minimize the monetary loss incurred due to unforeseen events such as: cancellations, missed connections, baggage loss, trip delay, and especially medical emergencies. The quoted plan provides insurance coverage that only applies during the covered trip. The Client may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages.

 

Please note that, unless the Client buys a “cancel-for-any-reason” policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place, but some are beginning to cover COVID-19 illness while traveling. No representation or description of the insurance made by the Agency constitutes a binding assurance or promise about the insurance.

 

The Client who decides not to purchase insurance coverage will be asked to sign a waiver indicating that they decline coverage. This waiver must be received by the Agency before the reservation can be completed. If you do not purchase travel insurance, you may lose refunds of any kind, and/or including deposits. Travel insurance costs are non-refundable after purchase. The Agency is not responsible for the services and policies imposed by Travel Insurance providers.

 

The Agency is not responsible for, nor will be held liable, for any injury, damages, or loss and/or loss of life the Client(s), or anyone in his/her travel party, may suffer during his/her trip. The Agency assumes no responsibility for disappointments at all or for any death, illness, sickness, disease, natural disaster, delay, accident, expenses, or defect that may result from your travel.  By embarking upon your travel, you voluntarily assume all risks involved in such travel, whether expected or unexpected. The Agency is not financially, or otherwise, responsible to make up any difference for non-covered insurance losses and travel expenses incurred by you. You, the Client, agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.

 

Required Information 

The Client is required to provide the Agency reasonable access to relevant personal information and documents, and the Client will be responsible for both the completeness and accuracy of the information provided to the Agency.

In conducting this engagement, information acquired by the Agency is subject to strict confidentiality requirements. The Client's information will not be disclosed by the Agency to other parties except as required or allowed for by law, or with your express consent.

  

Non-Discrimination Policy

 

Never Stop Packing Travel LLC is committed to creating a culture that reflects and welcomes the diversity of our clients. We believe that everyone deserves to feel safe during their most amazing vacation experience.  We welcome everyone and prohibit all discrimination based on race, ethnicity, age, religion, physical ability, sexual orientation, gender identity and gender.

 

Hostility Clause

 

Never Stop Packing Travel LLC reserves the right to terminate this Agreement if the travelers become uncooperative or hostile to the point where we are unable to complete the duties included in this Agreement. Offensive language or abusive behavior will not be tolerated at any moment of our business relationship.  Kindness is always greatly appreciated. If this clause is invoked, any monies paid will be forfeited by the Client.

 

E-mail Opt-In

 

By booking a trip with the Agency, you consent to receiving emails from us. If you would like to be removed from our marketing emails, please use the link in that email to unsubscribe or contact us for assistance.

 

Reservation Names and Contact Information

 

Upon receipt of your reservation, itinerary and/or travel documents, you must review and confirm that all information is correct. Names must be checked to make sure they are spelled correctly, as well as dates of birth for each traveler.  The names on all documents must be the traveler’s legal name and match the name exactly as stated on valid government-issued ID or passport. Valid government identification and/or passport numbers must also be checked for accuracy. 

 

The Agency will not be responsible for omissions and/or errors if not brought to our attention immediately. The Agency is not responsible for disruptions in the Client's travel plans or a declination in service due to travelers providing incorrect or delayed information.

 

International Travel Requirements

 

A valid US Passport is required for all international travel. The US Department of State recommends that passports are be valid for at least 6 months beyond the scheduled departure date. The Agency is not responsible for the issuance of travel identification such as passports and/or visas. Travelers should ensure they have or have been approved for the appropriate documents before purchasing travel.

 

Some countries have entry restrictions for people with criminal convictions.  Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. You can visit the US State Department Website (https://travel.state.gov/content/travel.html) for further information about these requirements. We do not inquire about an individual’s criminal record in the interest of respecting our Client’s privacy.

 

Travelers with prior criminal convictions are responsible for ensuring that they are not restricted to enter the destination by the laws of the country to which they are traveling. For example: Travelers with DUI/DWI convictions may be prohibited from traveling to Canada. It is the Traveler’s complete responsibility to check and verify any and all passport, visa, vaccination, or other entry requirements of your destination(s).

 

Passengers traveling without proper documentation or meeting destination requirements may be denied boarding or entry to an international destination and will not be entitled to a refund. For international travel, booking name must match your passport exactly (first, middle, last), no exceptions.  For information regarding passport applications or renewals, please visit the U.S. Department of State website (www.state.gov).  The Agency is not responsible for disruptions, or any type of loss, in your travel plans due to travelers providing incorrect information.

 

You, the Client, assume full and complete responsibility for checking and verifying all passports, visas, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination, during the length of the proposed travel.  If you are a citizen of another country, there may be additional requirements. Check with the nearest consulate or embassy of the destination you are traveling to and find out the entry requirements for non-U.S. citizens.

 

Passports

 

Everyone, including children and infants, MUST have a VALID passport book to travel internationally, this does not include a Passport Card.  Passport cards are not valid for international air travel. Failure to comply will result in denial of boarding and no refunds will be issued, no exceptions. The Agency is not responsible for passports in any way. Most international destinations require that your passport be valid for at least 6 months beyond your return date. For information regarding passport applications or renewals, please visit the U.S. Department of State website (www.state.gov).

 

Airline Tickets

 

If the Agency books your airline tickets, please note that your airfare is always name specific, 100% non-refundable and subject to individual airline penalties/fees. The Agency does not recommend and does not usually book Basic Economy fares due to these air fares lacking or not including baggage allowance, early boarding, seat assignment and/or upgrade availability. The Client understands that they are responsible for their seat selection, including any fees for upgraded seat assignments, if the Client has chosen to book Basic Economy airfare.

 

Airline Policies

 

The Agency is not responsible for the services and policies imposed by the airlines. Airline schedules and flights are subject to change without notice. It is the Client's responsibility to know and understand their airlines current travel policies and regulations. Flight details including departure times are always subject to change by the airlines and without. notice. It is the Client's responsibility to check in for the flight 24 hours in advance and reconfirm all gates and times upon arrival at the airport.

 

It is also the Client's responsibility to arrive at the airport on time; we recommend arriving no later than two (2) hours prior to your scheduled flight departure time, for domestic flights, and three (3) hours for international flights. We are required by law to tell you that federal law forbids the carriage of certain hazardous materials aboard the aircraft. If you do not understand these restrictions or have questions about it, please contact your airline or go to http://www.faa.gov/about/initiatives/hazmat_safety.

 

COVID-19 Traveler Acknowledgement and Risks of Travel

 

As the worldwide COVID-19 pandemic may remain ongoing for the near future, the Client acknowledges that for this reason, and other reasons not reasonably foreseeable at this time, the Client's travel plans may be interrupted or cancelled by the Supplier that is providing them, a government entity or other third party over which the Agency has no control.

 

The Agency has no responsibility for COVID-19-related requirements that travel Suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 or health screenings prior to departure or upon arrival, face coverings, or quarantines. The Client further acknowledges that the Supplier’s cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, continue to govern my rights and remedies, including the right to receive a refund, in such an event. For the latest travel Supplier rules, check the website of each Supplier, and continue checking because these rules are constantly changing, and the Agency is not responsible for those changes.  Moreover, the Client understands that if he/she elected to purchase travel insurance, the terms of the insurance policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances.

 

The Agency assumes no responsibility for and shall not be liable for the acts or omissions of any party not under our control, or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illnesses, weather hazards, or the suitability for a disabled person of any portion of any trip. The Agency has no special knowledge of dangers during travel or at destinations. The Agency shall not be responsible for any injuries, damages, or losses caused to any Traveler (Client) in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climactic conditions, criminal acts, or abnormal conditions or developments, or any other actions, omissions, or conditions outside the Agent's control.

 

The Agency has no special knowledge of health hazards such as the risk of contracting COVID-19, either during the Client's travel or at the Client's destination. For the latest travel health information and possible dangers at destinations, the Client should review the State Department's website at www.travel.state.gov and the CDC's information at www.cdc.gov/travel.

 

The Agency has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which the Client and his/her travel party may visit.  It is the Client's responsibility to know, understand and follow the rules and regulations established by travel supplier partners including but not limited to airlines, transportation companies, hotels, resorts and tour operators. The Client hereby releases the Agency from all claims arising out of any problem covered in these paragraphs.

 

It is the Client's personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

 

Traveling with Children

 

Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. The Agency is not responsible for lack of compliance on providing proper documentation to airport authorities when traveling with children. It is the responsibility of the Client and the parents/guardians to provide proper documentation to airport authorities. Americans with Disabilities Act (ADA)

 

Pursuant to the Americans with Disabilities Act (ADA), the Agency seeks to accommodate travelers with disabilities to the extent possible and consistent with your travel supplier’s offering. Passengers are required to advise the Agency of their accessibility requirements prior to booking in order for us to determine if reasonable accommodations are available. The Agency will do its best to accommodate special access needs but does not guarantee that it will be able to do so in all cases.

 

Financial Condition of Travel Suppliers

 

The Agency is not responsible for the acts or omissions of any Supplier or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund. The Agency has no liability for Supplier defaults or for recommending future travel credits with Suppliers that may be out of business by the time the Client tries to use the credits.

 

If requested by the Client, the Agency will assist with obtaining any refunds due or rebooking trips using future credits, but it will charge a non-refundable fee for such services.

 

The Agency will not be responsible, nor assume, any liability for any cancellation of services by the Supplier or any liability in arranging transportation, hotel and other accommodations, any changes or modifications by the Supplier of itineraries, air carrier, routing, scheduling, departure date, level of accommodations, fluctuations in fares, rates, exchange rates, surcharges, taxes, fees and/or price differentials.

 

Reservation Changes

 

Any changes made to any of the Client's existing reservations are subject to the current rates, promotions, and terms at the time of change. In the case of hotel reservations, if the number of individuals occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate.

 

If a Client makes changes to their reservation, an administrative processing fee of $25 will be assessed in addition to any travel Supplier fees. This processing fee is to cover our time spent processing your reservation change and the fee is per each change.

 

Cancellations

 

This planning Agreement only applies to travel planning services provided by Never Stop Packing Travel LLC. This Agreement does not represent any fees associated with resorts, airlines, and other vendor services.  Any resort, airline or vendor penalties incurred by the traveler due to changes or cancellations, are the sole responsibility of the traveler.   Payment of planning fees does not guarantee additional planning or travel services. Completion of additional travel services is dependent on Agency availability and is at the sole discretion of the Agency.

 

All deposits and payments are 100% non-refundable unless otherwise noted.  All Suppliers have their own cancellation policies. It is the responsibility of the Client to acquaint him/herself with said policies. Should a cancellation become necessary, please notify the Agency immediately in writing to info@neverstoppacking.com and request a written confirmation of your cancellation. Upon receipt, the Agency will follow industry procedures for refund as outlined in the Supplier’s policies and subject to review by the Supplier. The cancellation confirmation you will receive could be used for any potential travel insurance claims and any cancellation fees applicable will be applied to your account and invoiced for payment. Cancelation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the

Supplier’s refund. 

 

Voluntary cancellations of a scheduled and confirmed trip by the Client, for any reason, are subject to the terms and conditions of the Supplier. The Client should be aware that the Supplier may impose cancellation penalties, which should be reviewed in their respective cancellation policies. The Agency reserves the right to charge non-refundable service fees for processing any Client request such as changes, cancellations and/or refunds.

 

If the Client chooses to cancel any part of his/her trip due to fear for a destination, and the Supplier is still operating, the Client is still under any penalties which the Supplier may impose. The Agency has no control over said penalties which may be incurred from any Supplier & will not be held responsible for said penalties. Media reports or reports by other entities are not a valid reason for trip cancelation.

 

Should the Client’s itinerary contain various components, i.e. cruise, hotel, private guides, land excursions, air and any other types of travel services as it relates to his/her itinerary, the Client must be aware that if one or more parts of the itinerary is changed and/or cancelled, this does not guarantee all of the Suppliers involved in the transaction or itinerary will change or cancel their services, and the Client would be under all penalties which would be incurred by any of the other Suppliers. If a trip is completely canceled, travelers will be charged a $50 administrative processing fee for the cancellation of the Client's complete itinerary. This is separate and incremental to any fees or penalties levied by the travel Supplier and is to cover the time spent processing your booking and subsequent cancellation.

 

Should the Client make independent travel arrangements, apart from the arrangements the Agency has made on the Client's behalf, the Client accepts full responsibility for any and all penalties and changes set forth in the terms and set forth in those arrangements.

 

Final Payment

 

The final payment must be received by or before the due date. No payments are made automatically; you must communicate with your travel advisor to ensure payment is made before the due date. If payment is not received by the due date, your reservation is subject to cancellation by the Supplier(s) that are booked to provide you with their services. The Agency is not responsible for cancellations due to payments made past the due date.

 

Late Fees

 

Final payments not received on or before their due date will incur a $50 late fee. All reservations are subject to cancellation by the Supplier and Supplier penalties if final payment is not received by the due date. Late fees are not covered by the travel insurance and are always non-refundable.

 

Reservation Reinstatement Fee

 

If a Client cancels a trip and wishes to have their reservations reinstated, a $50 administrative processing fee will apply. This is in addition to any supplier fees and/or any price difference there may be at the time of reinstatement.

 

Declined Payment

 

A $25 fee will apply when a card is declined more than three times for a single payment. If you are using a debit card, please confirm that the proposed charge will be within your daily charge and transaction limit. Please contact your card issuer for more details.

 

Chargebacks

 

Trip payments are a binding agreement where you give the Agency approval to charge your card for the approved amount. As such, Clients waive any right to a chargeback in the case of trip delays, changes, or cancellations for any cause, except for fraud, including a force majeure event, and you agree to refund policies and procedures as outlined in the terms and conditions of your trip. In the event that you attempt to chargeback without our authorization, reverse, or recollect a trip payment already made, we reserve the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection including, without limitation, attorney fees.

 

Special Requests

 

Any special requests, such as dietary restrictions or accessibility needs, must be communicated to the Agency at the time of booking. While the Agency will make every effort to accommodate these requests, they cannot guarantee that all requests will be met.

 

Changes and Alterations

 

The Agency reserves the right to make alterations to the itinerary or services due to unforeseen circumstances. The Client will be informed of any such changes. If the Client wishes to make changes after confirming the travel arrangements, they may incur additional fees.

 

Privacy Policy

 

The Agency is committed to protecting the Client's personal information. Data collected will be used for booking purposes and to communicate relevant travel information. The Agency will not share the Client's information with third parties without consent, except where required for booking purposes.

 

Complaints and Feedback

 

If the Client has any concerns or feedback during their trip, they should immediately notify the Agency so that efforts can be made to address the issue. Any formal complaints should be submitted in writing within 14 days of the trip's conclusion.

 

Termination

 

Either party may terminate the engagement with written notice, under conditions that will be mutually agreed upon.

 

Amendments

 

The Agency reserves the right to amend these Terms at any time. The Client will be informed of any significant changes.

 

Governing Law

 

These Terms shall be governed by and construed in accordance with the laws of the United States of America, State of New York, and both parties agree to submit to the jurisdiction of the courts of United States of America, State of New York.

 

Disclaimer Of Liability

 

The Client s that the Agency is a travel agency acting as a mere agent for suppliers in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by this Agency such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc. This Agency, therefore, shall not be responsible for breach of contract of any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to you or your travel companions or group members. Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, we do not guarantee any of such suppliers' rates, bookings, reservations, connections, scheduling, or handling of personal effects.

 

The Client understands that the Agency shall not be responsible for any weather conditions, tour availability, injuries, damages, or losses caused to any traveler in connection with acts of God, terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, epidemics, pandemics, local laws, climatic conditions, criminal acts or abnormal conditions or developments, fail to comply with any applicable law or any other actions, omissions, or conditions outside the Agency’s and/or travel agent’s control.

 

The Client assumes complete and full responsibility for, and hereby releases the Agency from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department. For medical information, consult the Centers for Disease Control and Prevention. I will not hold the Agency responsible for any injury, damage or loss I may suffer while on any third party provided or operated excursion or activity. I understand that by embarking upon my travel, I voluntarily assume all risks involved in such travel, whether expected or unexpected. I understand that I hereby have been warned of such risks and am advised to obtain appropriate insurance coverage against them.

 

The Client's retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above, and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members. No refund can be made to the Client for unused services, unused transportation, unused sightseeing, unconsumed meals included in the package, (breakfast, lunch, dinner, tea) or for voluntary modifications made by the Traveler.

 

The Client, will review the travel documents for accuracy upon receipt and understand that the Client may notify the Agency with any questions. The Client understands that discounted fares typically involve restrictions and that changing any aspect of the travel arrangements may result in the payment of additional money. The Client has been advised to use a credit card as payment method as this may offer me the opportunity to dispute the charge should a vendor cease operating.

 

The Client understands that the Transportation Security Administration (TSA) requires everyone to carry a government issued identification card in order to board a flight. The Client has been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on the airline ticket and in the booking records. The Client acknowledges that failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing the Client to miss the flight.

 

The Client understands that if traveling internationally, the Client must have a valid passport and depending upon the destination and nationality, the Client may need to obtain one or more visas. The Client understands that the airline tickets, air tours or other products purchased are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by the Supplier or government. The Client acknowledges that the Client may be charged additional sums by the Agency to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof. The Client hereby consents to any post-purchase price increases and authorizes the Agency to charge the Client’s credit card for such additional amounts.

 

The Client understands that the Client may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

 

The Client understands that these terms are binding and that any dispute the Client may have must be resolved only by arbitration under the rules of the American Arbitration Association in the county in which Never Stop Packing Travel LLC is located.
